Terms of Use – Switched

1. Agreement
By purchasing or using Switched ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.
2. Developer
The App is developed and published by Jurgis Šaliamoras, phoquegames@gmail.com, operating under Lithuanian law and the law of the European Union.
3. Licence
I grant you a personal, non-transferable, non-exclusive licence to install and use the App on Android devices you own or control. You may not copy, modify, reverse-engineer, decompile, redistribute, sublicense, or sell the App or any part of it.
4. Purchase and refunds
The App is sold as a one-time purchase through Google Play. All purchases are final and processed by Google. Refund requests are handled according to Google Play's refund policy. I have no ability to process refunds directly.
5. No warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted operation. To the maximum extent permitted by applicable law, I disclaim all warranties.
6. Not a medical device
Switched is a personal reassurance and habit-tracking tool. It records the state you report — it does not verify whether a physical action has actually been performed. The App is not a medical device, does not diagnose or treat OCD or any other medical or psychological condition, and is not a substitute for professional medical, psychiatric, or psychological advice. If you have concerns about OCD or anxiety, please consult a qualified healthcare professional.
7. Limitation of liability
To the maximum extent permitted by Lithuanian and EU law, I am not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including any loss resulting from reliance on the App's recorded states.
8. Your data
All data you create in the App is stored locally on your device. I have no access to it. See the Privacy Policy for full details.
9. Governing law
These Terms are governed by the laws of the Republic of Lithuania and, where applicable, the law of the European Union. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Lithuania, except where mandatory consumer protection law in your country of residence provides otherwise.
10. Changes
I may update these Terms from time to time. Updated Terms will be published on the App's Play Store listing with a new effective date. Continued use constitutes acceptance.
