These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Vape.Not, located in Lithuania (“Vape.Not,” “we,” “us,” or “our”), governing your access to and use of the Vape.Not mobile application and all related features, services, and functionalities (collectively, the “Application”).

By downloading, accessing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Application.

1. SUBSCRIPTION AND IN-APP PURCHASES

1.1 Subscription

The Application may offer subscription plans granting access to premium features. By purchasing a subscription, you agree to:

  • Pay the applicable subscription fees displayed within the Application or App Store.

  • Pay any applicable taxes or charges imposed by your jurisdiction.

  • Allow automatic renewal unless you cancel the subscription through your device’s account settings.

We reserve the right to modify, discontinue, or adjust subscription offerings at our sole discretion.

1.2 In-App Purchases

The Application may include additional in-app purchases. When making such purchases:

  • We receive only transaction-related metadata (e.g., purchase date, product type, and amount).

  • We do not collect or process any payment card details, billing addresses, or banking information.

  • All financial transactions are processed securely by the Apple App Store or Google Play Store.

Refunds, if applicable, must be requested directly through the platform where the purchase was made.

2. INTELLECTUAL PROPERTY RIGHTS

The Application and all related content—including but not limited to text, graphics, logos, icons, images, features, code, and software architecture—are owned by Vape.Not or its licensors and are protected under copyright, trademark, and other applicable intellectual property laws.

Except as expressly permitted below, you must not copy, reproduce, modify, publish, distribute, create derivative works of, or otherwise exploit any part of the Application:

  1. Temporary copies stored in RAM incidental to your use are permitted.

  2. Automatically cached files may be stored by your device or browser for display optimization.

  3. You may print or download a reasonable number of pages for strictly personal, non-commercial use.

Any unauthorized use of the Application may result in legal action.

3. INFORMATION WE COLLECT

Vape.Not collects anonymous, non-personal analytics data strictly for internal operational purposes. This includes, but is not limited to:

  1. Device information, such as hardware model, operating system version, and language settings.

  2. Application usage metrics and interaction patterns.

  3. Crash logs and diagnostic data.

All data we process is aggregated and anonymized.

4. USE OF INFORMATION

We use the anonymous analytics data solely for internal purposes, including:

  • Improving Application performance and stability

  • Fixing bugs and optimizing existing features

  • Understanding user behavior to guide development

  • Creating aggregated, non-identifiable usage reports

This information helps us ensure the Application functions properly and evolves in line with user needs.

5. DISCLOSURE OF INFORMATION

We do not sell, rent, distribute, or disclose any data collected through the Application to third parties.

Data may be disclosed only in the following exceptional circumstances:

  1. Legal Compliance: When required to comply with applicable laws, regulations, or valid legal requests.

  2. Protection of Rights: When necessary to protect the rights, property, or safety of Vape.Not, our users, or others.

Under no circumstances do we share data for advertising, marketing, or commercial purposes.

6. USER CHOICES

You may use the Application without providing any personal information. Additionally, you may disable analytics or usage tracking via your device settings, such as turning off “Usage Data,” “Tracking,” or similar system-level options.

Some features may function differently when analytics are disabled.

7. TERMINATION

We reserve the right to suspend or terminate your access to the Application at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms

  • Suspected abusive or unlawful behavior

  • Interference with the Application’s operation

Termination does not entitle you to a refund unless required by your platform provider’s policies.

8. DISCLAIMER OF WARRANTIES

The Application is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied.

We do not warrant that:

  • The Application will operate without interruption or errors

  • Defects will be corrected

  • The Application or its servers are free from viruses or harmful components

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Vape.Not shall not be liable for any:

  • Indirect, incidental, consequential, punitive, or special damages

  • Loss of profits, data, goodwill, revenue, or business opportunities

  • Damages arising from inability to access or use the Application

Even if we have been advised of the possibility of such damages.

Your sole remedy for dissatisfaction with the Application is to discontinue its use.

10. GOVERNING LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of Lithuania, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Application shall be subject to the exclusive jurisdiction of the courts of Lithuania.

11. CHANGES TO THESE TERMS

We may update or modify these Terms at any time at our sole discretion. Any revisions will be effective upon posting the updated Terms within the Application or on an associated platform.

Your continued use of the Application following such changes constitutes acceptance of the updated Terms.
